ABOUT ALOKA & SOL
Aloka & Sol is a Western Australian creative studio creating one-of-a-kind wearable artworks and textile art from reclaimed materials. Each piece is individually made or transformed, meaning variations in colour, texture, pattern, fabric and finish are an inherent part of the work.
PRODUCTS AND DESCRIPTIONS
Every Aloka & Sol piece is unique. We make every effort to accurately represent each garment and artwork through photographs, descriptions and measurements. Colours may appear slightly different depending on your screen and device. For wearable pieces, actual garment measurements are provided where applicable. These measurements are intended to help you determine how a garment may fit and are more useful than relying solely on the original size label. Because reclaimed garments and fabrics vary in construction, fit and proportions, measurements and descriptions should be considered carefully before purchasing. For artworks, dimensions refer to the artwork and/or finished framed piece as specified in the individual product listing.
ONE-OF-A-KIND WORKS
Due to the reclaimed materials and organic nature of the dyeing process used by Aloka & Sol, no two pieces are identical. Natural variations, irregularities, marks, changes in colour and other characteristics may form part of the original garment, fabric, frame or dye process. These characteristics are part of the individual nature and history of each piece and are not necessarily defects. Any significant condition issues that may affect a product are disclosed in its individual listing.
PRICING
All prices displayed on the Aloka & Sol website are in Australian dollars (AUD). Prices are subject to change without notice. Any price change will not affect an order that has already been accepted and paid for. We take care to ensure that product and pricing information is accurate. If an obvious pricing or listing error occurs, we will contact you as soon as reasonably possible to discuss the situation.
ORDERS
When you place an order through the website, you are making an offer to purchase the selected product. An order is not considered accepted until payment has been successfully processed and Aloka & Sol has confirmed the order. If we are unable to fulfil an order, we will contact you and provide an appropriate resolution, including a refund where applicable.
PAYMENT
Payments are processed securely through the payment methods available at checkout. Aloka & Sol accepts payments through Squarespace Payments, including supported card and digital payment methods. Afterpay may also be available for eligible purchases. Payment must be successfully completed before an order can be processed.
SHIPPING, COLLECTION AND RETURNS
Shipping, local collection and returns are governed by our Shipping & Returns Policy, which forms part of these Terms & Conditions. Please review that policy before placing an order.
AUSTRALIAN CONSUMER LAW
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. These rights apply in addition to any policies offered by Aloka & Sol.
INTELLECTUAL PROPERTY All content on the Aloka & Sol website, including artwork, photographs, written content, branding, logos, designs and original creative work, belongs to or is used by Aloka & Sol with permission. This content may not be reproduced, copied, modified, distributed or used commercially without prior written permission. Purchasing an artwork or garment does not transfer copyright or intellectual property rights in the artwork, design, photography or other creative content to the purchaser.
WEBSITE USE
You agree to use the Aloka & Sol website lawfully and in a way that does not interfere with the operation or security of the website. You must not use the website to copy, reproduce, distribute or commercially exploit Aloka & Sol content without permission.
WEBSITE AVAILABILITY
We aim to keep the website accurate and available, but we cannot guarantee that the website will always be uninterrupted, error-free or available. We may update, change or temporarily suspend parts of the website when necessary.
LIMITATION OF LIABILITY
To the extent permitted by law, Aloka & Sol is not responsible for losses arising from your use of the website where those losses are not reasonably foreseeable or are not caused by a breach of our legal obligations. Nothing in these Terms limits any rights you have under the Australian Consumer Law or other applicable laws.
